1. Agreement to Terms

These Terms and Conditions ("Terms") form a legally binding agreement between you and Corvidae Limited (New Zealand) ("Corvidae", "we", "us", "our") relating to your access to and use of GetShortlisted (the "Service").

By accessing or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

2. Description of the Service

GetShortlisted is a professional CV optimisation platform that helps you transform plain-language work experience into polished, professional CV content. The Service may include:

• AI-assisted CV wording and optimization
• English level matching for non-native speakers
• Application tracking and management
• CV version control and tailoring for different roles
• Export functionality in ATS-friendly formats

The Service provides tools and suggestions. It does not provide legal, immigration, financial, or employment advice, and it does not guarantee job interviews, offers, or outcomes.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You may sign in using your email and password, or via third-party authentication providers (Google, Microsoft, LinkedIn, or Apple). You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

3.2 Account Eligibility

You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this age requirement.

3.3 Security

You are responsible for maintaining the confidentiality of your login details and for all activities that occur under your account. Please notify us promptly if you suspect unauthorised access.

4. Acceptable Use

4.1 Permitted Use

You may use the Service for lawful purposes only, including:

• Creating and optimizing your own professional CV
• Tracking your job applications
• Generating professional wording for your actual experience

4.2 Prohibited Conduct

You agree NOT to:

• Falsify, misrepresent, or fabricate your work experience or qualifications
• Use the Service to create CVs for others without permission
• Resell, redistribute, or commercialize the Service without authorization
• Attempt to reverse engineer, decompile, or extract source code
• Use automated systems (bots, scrapers) to access the Service
• Interfere with or disrupt the Service or servers
• Upload malicious code, viruses, or harmful materials
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Harass, abuse, or harm other users

We may investigate suspected misuse and may suspend or terminate access to protect the Service, users, and our rights.

5. Intellectual Property

5.1 Our Content

The Service and its original content, features, and functionality are owned by GetShortlisted and are protected by international copyright, trademark, and other intellectual property laws.

5.2 Your Content

You retain all rights to the content you input into the Service (your work experience, education, skills, etc.). By using the Service, you grant us a limited license to:

• Process your content to provide the Service
• Store your content on our servers
• Use AI to optimize and improve your CV wording

This license ends when you delete your content or account.

5.3 AI-Generated Content

The AI-optimized wording generated by our Service is based on your input. You own the final CV content you create and export. We do not claim ownership of AI-generated suggestions based on your information.

You acknowledge that AI output may be inaccurate or incomplete, and you are responsible for reviewing and deciding whether to use any suggestion.

6. User Responsibilities

You are solely responsible for:

• Accuracy: Ensuring all information in your CV is truthful and accurate
• Review: Reviewing and verifying all AI-generated content before use
• Compliance: Ensuring your CV complies with applicable employment laws
• Usage: How you use the exported CV content
• Consequences: Any outcomes from using your CV in job applications

Important: GetShortlisted is a tool to help you articulate your genuine experience professionally. We do not endorse or encourage misrepresentation of qualifications.

7. Payment and Subscriptions

7.1 Free Services

Certain features of the Service are available for free. We reserve the right to modify or discontinue free features at any time.

7.2 Paid Services

If we offer paid features, additional terms will apply:

• All fees are in the currency stated at the time of purchase
• Subscriptions automatically renew unless canceled
• Refunds are subject to our refund policy
• We reserve the right to change pricing with notice

Taxes, bank fees, and currency conversion charges (if any) are your responsibility unless stated otherwise.

8. Disclaimers and Limitations

8.1 Service Availability

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free operation
• Specific results from using the Service
• Employment outcomes or interview success
• Compatibility with all devices or browsers

8.2 No Employment Guarantees

GetShortlisted is a CV optimization tool. We do not guarantee job offers, interviews, or employment outcomes. Your success depends on many factors beyond CV wording.

8.3 AI Limitations

While our AI strives to provide professional suggestions, it may occasionally produce imperfect results. You must review and verify all generated content.

8.4 Third-party services

The Service relies on third-party services to operate. These include but are not limited to:

• OpenAI: AI processing for CV enhancement and professional wording suggestions
• Google: Analytics and OAuth authentication
• Microsoft, LinkedIn, Apple: OAuth authentication services
• Hosting and infrastructure providers: Cloud hosting and content delivery

We are not responsible for the availability, functionality, or data practices of third-party services. However, we select reputable providers and apply appropriate contractual safeguards. Each third-party service's own terms of service and privacy policies apply to their services.

9. Limitation of Liability

To the fullest extent permitted by law, Corvidae will not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Employment-related outcomes or decisions
• Damages arising from unauthorized access to your account
• Third-party actions or content

Our total aggregate liability arising out of or in connection with the Service will not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim. If you have not paid us anything in that period, our total aggregate liability will not exceed NZD $100.

Nothing in these Terms limits any rights you may have under applicable laws that cannot be excluded. If you are a consumer in New Zealand, the Consumer Guarantees Act 1993 may apply.

10. Indemnification

You agree to indemnify and hold harmless Corvidae from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Misrepresentation in your CV content

11. Termination

11.1 By You

You may delete your account at any time through your account settings.

11.2 By Us

We reserve the right to suspend or terminate your access immediately, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abusive behavior
• Any reason at our sole discretion

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Your continued use after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions.

14. Dispute Resolution

If you have a dispute with us, please contact us first to attempt resolution. If we cannot resolve the dispute informally, you agree that any legal action must be brought in the courts of New Zealand.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
